A (in) eficácia da lei de inclusão social em relação ao surdo

The present article pursuit verifying and analyzing the Brazilian law n° 13146/2015. The main purpose of the law is giving inclusion to disabled people and so ensuring the constitutional principles. It is the human rights field that seek the enforcement of the human dignity with an international scope, serving as basis for the creation of Federal Constitution of Brazil. The study exhibit the constitutional principles about the human dignity and principles of equality. This article also approaches the social inclusion of disabled people issue and the infra-constitutional legislation applied to deaf people. Still, it was analyzed the Brazilian Sign Language (Libras/LSB) as established by its own law, and the matter of its knowing. More, it approaches the efficiency of the law n° 13146/2015, bringing its applications to the daily life, and the intervention of the judiciary as a way of imposing its application through hiring interpreters of Brazilian Sign Language. Lastly, analyzing the article, it is concluded that Libras is the best and more effective way of inclusion to deaf.
